These Terms apply to all visitors, customers, and others who access the website or request services. We may update these Terms at any time. The most current version will always be posted on this page with the effective date updated.
French Valley Asphalt Paving provides asphalt paving, sealcoating, repair, striping, parking lot maintenance, driveway paving, and related services to residential and commercial customers in French Valley, California and surrounding Riverside County communities.
Service availability is subject to scheduling, material availability, weather conditions, and site access. We reserve the right to decline any project at our discretion.
All written estimates are based on conditions observed at the time of the site visit. Final pricing may be adjusted if site conditions differ materially from what was observed during the estimate - for example, if subsurface conditions, hidden damage, or access issues are discovered once work begins. We will notify you before proceeding with any work that would result in a price change.
Verbal estimates are not binding. Only written, signed estimates or contracts constitute a commitment by the Company. Estimates are valid for 30 days from the date issued, unless otherwise noted, as material costs are subject to change.
Prices are quoted in US dollars and do not include permit fees unless explicitly stated in the written estimate. Permit fees, if applicable, are the responsibility of the customer unless the estimate states otherwise.
Scheduled work dates are subject to weather conditions, material availability, and equipment availability. We reserve the right to reschedule a job due to rain, extreme heat, or other conditions that would compromise the quality of the work. We will notify you as promptly as possible if a rescheduling is necessary.
If you need to cancel or reschedule a confirmed appointment, please notify us at least 48 hours in advance. Cancellations with less than 48 hours notice may result in a cancellation fee to cover mobilization costs, as specified in your written agreement.
Jobs that require customer preparation - such as clearing vehicles, removing obstacles, or marking underground utilities - must be completed before the crew arrives. If the site is not ready and the crew must return, a remobilization fee may apply.
Payment terms are specified in your written estimate or contract. Unless otherwise agreed in writing, a deposit may be required before work begins, with the remaining balance due upon completion.
Accepted payment methods are listed in your written agreement. Payments not received by the due date may be subject to a late fee as specified in the contract. Unpaid balances may be subject to collection action, including but not limited to filing a mechanics lien on the property where work was performed, as permitted under California law.
All sales are final once work has been completed as described in the written scope. Disputes regarding the scope of work must be raised before the crew leaves the property.
Any workmanship warranty provided is limited to defects in installation and is specified in your written contract. Warranties do not cover damage caused by normal wear and tear, vehicle traffic beyond the stated design load, acts of nature, soil movement, tree roots, improper maintenance by the customer, or conditions that existed prior to our work.
Asphalt is a natural material subject to oxidation, fading, and surface deterioration over time, particularly in high-UV environments such as inland Southern California. These characteristics are not defects and are not covered under any workmanship warranty. Regular maintenance, including sealcoating, is the customer's responsibility.
We make no warranty, express or implied, beyond what is stated in your written contract. The Company disclaims all implied warranties, including fitness for a particular purpose and merchantability, to the fullest extent permitted by law.
To the fullest extent permitted by applicable law, French Valley Asphalt Paving shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to the services provided or the use of this website, including lost profits, loss of use, or data loss.
Our total liability to you for any claim arising out of services performed shall not exceed the total amount you paid us for the specific job giving rise to the claim.
We are not responsible for damage to underground utilities, irrigation lines, cables, or other subsurface infrastructure that was not properly marked or disclosed before work began. It is the customer's responsibility to identify and mark all underground utilities through the appropriate call-before-you-dig service prior to our arrival.
You are responsible for obtaining any required permits for your project unless the written estimate explicitly states we will handle permitting. You are also responsible for notifying your homeowners association (if applicable) and obtaining any required approvals before work begins.
You agree to keep the work area clear of children, pets, and vehicles during active work and during the curing period specified by our crew. Damage to a freshly paved or sealed surface caused by premature traffic is the customer's responsibility.
If a dispute arises out of or relates to these Terms or the services provided, we encourage you to contact us directly first. Most concerns can be resolved quickly through direct communication.
If direct resolution is not possible, the parties agree to attempt mediation before pursuing litigation. Any legal action not resolved through mediation shall be filed in the appropriate court in Riverside County, California.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. You consent to the exclusive jurisdiction of the state and federal courts located in Riverside County, California for any disputes arising under these Terms.
